Commercial Litigation & Arbitration

Instructed when it matters most

Commercial disputes are often decided early, by who secures the evidence and assets first. Some need urgent court orders within days.

Why you need it

A business partner moves money out of the company. A former employee takes the customer database. A counterparty stops paying and starts moving assets. In each case, waiting can mean the money or the evidence is gone by the time judgment is given. Interim injunctions, search orders and asset freezing orders are available, but they must be applied for quickly and with full and frank disclosure.

Many disputes also have a cross-border side: an arbitration clause, a foreign counterparty, assets in another country, or sanctions issues. Choosing the right forum and getting enforcement right matters as much as winning on the merits.

How we help

We act in the Singapore courts and in arbitration, for claimants and defendants. Past work includes, as second chair, obtaining urgent injunctions for a Singapore education group and taking five related High Court suits to trial; defending and counter-claiming in five High Court suits for a medical group over directors’ duties and shareholders’ agreements; acting for a Malaysian state government in an SCMA shipping arbitration that settled; acting for an American company on a US$220 million fraud claim against an Indian respondent, including the validity of the arbitration agreement and enforcement in India; and, instructed by Dentons Europe, advising a South American government on enforcement-related proceedings in Singapore over joint-venture assets involving a PRC state-owned entity and OFAC sanctions.

We have also handled intellectual property disputes, including injunctions to protect customer databases, employment disputes for senior executives, and medical negligence claims.
